These Terms & Conditions ("Terms") are an agreement between you and AIMEE KLAIRE FRENCH LLC, a Montana limited liability company ("Qi Plate," "we," "us," or "our") governing your use of the Qi Plate website and mobile application (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

2. Not medical advice

Qi Plate provides general wellness and educational content inspired by Traditional Chinese Medicine, generated in part by artificial intelligence. It is not medical advice, diagnosis, or treatment, and it is not a substitute for care from a licensed healthcare professional. AI-generated readings and meal plans may be inaccurate or incomplete. Always consult a qualified clinician before changing your diet, taking supplements, or acting on any recommendation, especially if you are pregnant, nursing, taking medication, or managing a medical condition. You use the Service at your own risk, and you are responsible for checking recipes for allergens and ingredients that are unsafe for you.

3. Your account

You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Tell us immediately at support@qiplate.com if you suspect unauthorized use. One account per person; accounts may not be shared, resold, or transferred.

4. Subscriptions, free trial, and billing

  • Plans. Premium is offered at $9.99 per month or $70 per year, in U.S. dollars, plus any applicable taxes.
  • Free trial. Eligible new subscribers receive a 7-day free trial. Your payment method is charged automatically when the trial ends unless you cancel before then. The trial is available once per customer.
  • Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel.
  • Cancellation. Cancel any time from Account → Manage billing. Cancellation stops future charges; your premium access continues until the end of the period you already paid for.
  • Refunds. Except where required by law, payments are non-refundable and partial periods are not prorated. If you believe you were charged in error, email support@qiplate.com.
  • Payment processing. Payments are processed by Stripe and are subject to Stripe's terms. We do not store your card details.
  • Price changes. We may change prices with notice before the change takes effect for your next renewal.
  • App store purchases. If you subscribe through an app store, that store's billing, cancellation, and refund rules apply instead, and you manage your subscription in your app store account settings.

5. Acceptable use

You agree not to:

  • Upload photos of anyone other than yourself, or without their permission.
  • Upload unlawful, abusive, or infringing content.
  • Reverse engineer, scrape, or resell the Service or its output.
  • Interfere with the Service's security, availability, or rate limits.
  • Use the Service to provide medical services to others.

6. Your content

You keep ownership of the photos and information you submit. You grant us a limited license to process them solely to operate the Service and generate your reading. See our Privacy Policy for how we handle this data.

7. Our content

The Service, including its text, design, code, and branding, is owned by us and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use.

8. Third-party links and affiliate disclosure

The Service links to third-party retailers, including Amazon and Whole Foods Market. We participate in the Amazon Associates program and may earn a commission on qualifying purchases at no extra cost to you. We are not responsible for third-party sites, their products, pricing, availability, or policies.

9. Availability and changes

We may modify, suspend, or discontinue features at any time. We aim for high availability but do not guarantee uninterrupted or error-free service.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you breach these Terms or if we are required to do so by law. Sections that by their nature should survive termination will survive.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow these limits, so they may not apply to you.

13. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or violation of these Terms or applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws rules. The state and federal courts located in Montana will have exclusive jurisdiction, and you consent to venue there. Nothing prevents either party from seeking relief in small-claims court.

15. Changes to these Terms

We may update these Terms. We will update the "Last updated" date and, for material changes, notify you in the app or by email. Continued use after changes take effect means you accept them.
